Florida Statute 812.014 defines theft as knowingly and unlawfully obtaining or using or endeavoring to obtain or use the property of another, doing so with the intent to temporarily or permanently deprive someone of his or her right to the property or any benefit from the property, or by appropriating the property for his or her own use or the use of any person not entitled to it.

Types of Theft in Florida

Petit Theft is a theft that occurs where the value of the property is less than $300. If the value of the property is less than $100, then the crime is a Misdemeanor of the 2nd Degree. A Misdemeanor of the 2nd Degree is punishable by up to 60 days in jail or 6 months of probation.

Grand Theft is a felony of the 3rd Degree, punishable by up to 5 years in prison or 5 years of supervised probation and a $5,000 fine. Some of types of Grand Theft include:

  1. Value of the property is $300 or more, but less than $5,000
  2. Value of the property is $5,000 or more, but less than $10,000
  3. Value is $10,000 or more, but less than $20,000
  4. A firearm
  5. A motor vehicle
  6. Any stop sign
  7. A controlled substance

Grand Theft is a felony of the 2nd Degree, punishable by up 15 years in prison or 15 years in supervised probation and a $10,000 fine if the property is valued at $20,000 or more, but less than $100,000.

Grand Theft is a felony of the 1st Degree, punishable by up 30 years in prison and a maximum fine of $10,000, if the property is valued over $100,000.
